PURCHASE OF PRODUCTS

The following terms apply to the purchase of products and services from Co-operativepharmacy.co.uk and apply in addition to our general terms and conditions.

Onward dispatch outside the UK

The Co-operative Pharmacy operates the online pharmacy for customers based in the UK market and therefore we do not deliver to customers, businesses, courier or shipping companies for onward dispatch outside the UK. As a retail consumer site we do not intend our website to be used for wholesaling or bulk purchasing and therefore we have a restriction on the total purchase quantity of any health related lines, which includes baby milk. Our Customer Care Team will not dispatch any orders which contravene these terms.

Residency and your status

We do not accept orders from individuals outside of the UK.

By placing an order through our site, you warrant that you are at least 18 years old.

Registration

All customers of www.co-operativepharmacy.co.uk are required to register with us in order to make a purchase.  This is to enable us to ensure that your order is as secure as possible, and to safeguard patients where prescriptions are being dispensed.  During the registration process we will take your email address and a few basic personal details.  We will also ask you to create a password.   You will then have an account with us, where you will be able to keep track of all your orders.

How the contract is formed between you and us

After placing an order, you will receive an e-mail from us acknowledging that we have received your order.  Please note that this does not mean that your order has been accepted.  Your order constitutes an offer to us to buy a product.  All orders are subject to acceptance by us, and we will confirm such acceptance to you by sending you an e-mail that confirms that the product has been dispatched (Dispatch Confirmation).  The contract between us will only be formed when we send you the Dispatch Confirmation.

Cancellation rights

If you are contracting as a consumer, you may cancel the contract at any time within seven working days, beginning on the day after you received the products.  In this case, you will receive a full refund of the price paid for the products in accordance with our refunds policy.

To cancel a contract, you must inform us in writing. You must also return the products to us immediately, in the same condition in which you received them, and at your own cost and risk.  You have a legal obligation to take reasonable care of the Products while they are in your possession. If you fail to comply with this obligation, we may have a right of action against you for compensation.

This provision does not affect your other statutory rights as a consumer.

Delivery, risk and title

Your order will be completed by the delivery date set out in the Dispatch Confirmation.  In exceptional circumstances beyond our control, we might not always be able to deliver within the stated timescales.  Should this situation arise, we will contact you by email or phone.  If the estimated delivery time is unacceptable to you, you will be given the option to cancel your order with a full refund.  Should you wish to proceed with your order in this situation we may, at our discretion, waive the delivery charge.

The products will be at your risk from the time of delivery. Ownership of the products will only pass to you when we receive full payment of all sums due in respect of the products, including delivery charges.

Price and payment

The price of the products and our delivery charges will be as quoted on our site from time to time, except in cases of obvious error.  Product prices include VAT.

Product prices and delivery charges are liable to change at any time, but changes will not affect orders in respect of which we have already sent you a Dispatch Confirmation.

Our site contains a large number of products and it is always possible that, despite our best efforts, some of the products listed on our site may be incorrectly priced.  We will normally verify prices as part of our dispatch procedures so that, where a product's correct price is less than our stated price, we will charge the lower amount when dispatching the product to you.  If a product’s correct price is higher than the price stated on our site, we will normally, at our discretion, either contact you for instructions before dispatching the product, or reject your order and notify you of such rejection.

We are under no obligation to provide the product to you at the incorrect (lower) price, even after we have sent you a Dispatch Confirmation, if the pricing error is obvious and unmistakeable and could have reasonably been recognised by you as an error.

The prices on our website are only indicative of our online prices and do not necessarily reflect the prices or promotional offers that can be found in Co-operative Pharmacy branches. Branch prices and offers may differ from those shown on the website.

Payment for all products must be by credit or debit card.  We accept payment with most major credit or debit cards. Your payment card is charged at the point your order is processed.  We do not accept American Express, Solo and Maestro cards.

Our returns policy

Warranty

We warrant to you that any products purchased from us through our site will, on delivery, conform in all material respects with its description, be of satisfactory quality, and be reasonably fit for all the purposes for which products of that kind are commonly supplied.

You may have additional manufacturers’ warranties with some products such as electrical items giving you additional rights and you should check these carefully.

Liability

If we fail to comply with these terms and conditions, we shall only be liable to you for the purchase price of the products and any losses that you suffer as a result of our failure to comply (whether arising in contract, tort (including negligence), breach of statutory duty or otherwise) which are a foreseeable consequence of such failure.

Promotions start and end dates

All products on promotion will be from 04 April 2013 until 01 May 2013 and available for the duration of this period unless otherwise stated on the marketing or product information. We retain the right to remove a product from promotion or from the website at any time.

Should you wish to proceed with your Order in this situation we may, at our discretion, waive the delivery charge.

The product will be at your risk from the time of delivery. Ownership of the products will only pass to you when we receive full payment of all sums due in respect of the products, including delivery charges.

Please note that we only deliver to addresses within England, Scotland, Wales and Northern Ireland.

Price and Payments

The price of the products and our delivery charges will be as quoted on our site from time to time except in cases of obvious error. Product prices include VAT.

Product prices and delivery charges are liable to change at any time, but changes will not affect orders for which we have already sent you an Order Confirmation.

We are under no obligation to provide the product to you at the incorrect (lower) price, even after we have sent you a Dispatch Confirmation, if the pricing error is obvious and unmistakable and could have reasonably been recognized by you as an error.

Payments for all photo products are processed through WorldPay's secure server. We accept payments made with most major credit or debit cards. We will not charge your credit or debit card until we dispatch your order but authority for payment must be given at the time of order. We do not accept American Express or Solo.

Returns
